TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and use of the studios, equipment, facilities, website and booking platform operated by Resident Studios ("Resident Studios", "we", "us", "our"). By making a booking, entering our premises or using our services, you agree to be bound by these Terms. If you do not agree, you must not make a booking or enter the premises.
Resident Studios is governed by the laws of the Commonwealth of Australia and the State or Territory in which the relevant studio is located. Nothing in these Terms excludes, restricts or modifies any consumer rights you have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
1. Eligibility and Account
You must be at least 18 years of age to make a booking, hold an account or enter the premises. We may request photo identification at any time and refuse entry if proof of age cannot be provided. Persons under 18 are not permitted on the premises under any circumstances, including as guests.
You are responsible for keeping your account credentials confidential. You are liable for all activity on your account, including bookings made and breaches of these Terms by anyone using your account.
You must provide accurate and current information when registering and when making a booking. Providing false information is grounds for immediate termination of your account and forfeiture of any payments made.
2. Bookings and Payment
A booking is confirmed only once full payment has been received. Pricing is displayed at the time of booking and may vary by room, day and time.
Your booking entitles you to use of the specified room, for the specified time slot, with the equipment provided. Bookings start and end at the times shown — set-up and pack-down must occur within the booked time.
Any equipment, instruments or items you bring to the premises remain your sole responsibility. We are not liable for loss, theft or damage to your personal property.
3. Cancellations and Refunds
48-hour policy: You may cancel a booking and receive a full refund provided you cancel at least 48 hours before the scheduled start time of the booking.
Cancellations made less than 48 hours before the scheduled start time are non-refundable. No refund or credit will be issued, including for no-shows, late arrivals or partial use of the booked time.
Refunds are processed to the original payment method and may take 5–10 business days to appear in your account.
If we cancel a booking due to a fault on our part (for example, equipment failure that prevents use of the room and cannot be remedied), you will be offered a full refund or a credit of equivalent value, at your election.
Nothing in this clause limits any non-excludable rights you may have under the Australian Consumer Law.
4. PIN and Access
PINs are personal and non-transferable. Each booking is issued with a unique PIN that grants access to the premises and your booked room. You must not share, disclose, copy or otherwise transfer your PIN to any other person.
Sharing a PIN, attempting to enter the premises outside your booked time, or using a PIN issued to another person constitutes a serious breach of these Terms and will result in a fine (see Schedule of Fines), forfeiture of the booking, and may result in suspension or permanent termination of your account.
You must not allow any other person to enter the premises using your PIN, including persons not registered as guests on your booking.
You are responsible for any unauthorised entry, damage or loss caused by a person who entered using your PIN, whether you authorised that entry or not.
5. Overstay
You must vacate the room by the end of your booked time. If you remain in the room past your booked end time, you will be charged an overstay fee equivalent to the average hourly rate of your booking, charged per hour or part thereof.
Overstay fees will be automatically charged to the payment method on file. We reserve the right to enter the room, end your session and remove you and your guests if you fail to vacate, and you accept that any such removal will not entitle you to a refund.
Where your overstay causes a delay or loss of use to the next booking, you may be liable for the cost of any refund or credit we are required to provide to that customer.
6. Guests
Guest limits: Maximum 4 guests in a regular room. Maximum 8 guests in a premium room. These limits include all persons in the room at any time, including the booker.
All guests must be at least 18 years of age and must be registered against your booking before entering the premises. We may require photo identification from any guest.
You are fully responsible for your guests — their conduct, compliance with these Terms, any damage they cause and any fines incurred. Only bring people you would invite into your own home.
Exceeding the guest limit will result in immediate termination of your session without refund, and may result in a fine and account suspension.
7. Conduct and House Rules
No food or drink in studio rooms. Eating is permitted only in designated common areas. Sealed water bottles are the only beverages permitted inside studio rooms; all other drinks must remain in common areas.
No smoking or vaping anywhere on the premises. This includes all rooms, hallways, common areas and any indoor space. Smoking and vaping are permitted only in designated outdoor areas.
Zero tolerance for illegal drugs. The use, possession, sale or distribution of any illegal drug or controlled substance anywhere on the premises is strictly prohibited and will result in immediate termination of your session, forfeiture of payment, permanent banning of your account, and may be reported to police.
No ticketed events or paid entry. You may not organise, promote, host or facilitate any event at Resident Studios that involves the sale of tickets, entry fees, cover charges or any other form of paid admission, without prior written consent from Resident Studios. Breach will result in immediate termination of the session, forfeiture of payment, and may result in account suspension and legal action.
You must not interfere with, tamper with, cover, disable, remove or damage any CCTV camera, smoke detector, fire alarm, lock, sensor or other safety, security or access control equipment.
You must report any equipment fault, damage, spillage or safety concern to us immediately during your session. Faults reported after your session ends may not be eligible for refund or credit.
You must leave the room in the same clean and tidy condition in which you found it. Place rubbish in the bins provided, return equipment to its original position and report anything broken.
You must respect other customers, our staff and our neighbours. Excessive noise outside the rooms, abusive behaviour, threats, harassment, violence or anti-social conduct of any kind will result in immediate termination of your session and may result in permanent banning.
8. Equipment and the Studio
Equipment is provided on an "as is" basis. While we maintain our equipment regularly, we do not warrant that any specific piece of equipment will be available, fully functional or fault-free during your booking.
Use the equipment only for its intended purpose and in accordance with any instructions provided. Do not connect personal equipment to the studio system in a way that risks damage.
If equipment is faulty, contact us immediately. Where a fault materially prevents you from using the room and we cannot remedy it, you will be offered a credit or refund for the affected portion of the booking.
9. Liability for Damage
You are liable for the full cost of repair or replacement of any equipment, fixture, fitting, surface or other property damaged by you, your guests or any person who entered the premises using your PIN, whether the damage was intentional, accidental or caused by misuse or negligence.
Replacement value is the cost of a new equivalent item including any freight, installation and labour costs. We will provide reasonable evidence of cost on request. There is no cap on damage liability.
Damage costs may be charged automatically to the payment method on file. Where the damage exceeds the available limit on that method, you remain liable for the balance.
10. CCTV, Access Logs and Privacy
CCTV consent. The premises are monitored by closed-circuit television (CCTV) cameras in common areas, entrances, exits and corridors. By entering the premises you consent to being recorded. CCTV is not installed inside individual studio rooms or bathrooms.
Access logs. We record entry and exit events including the date, time, PIN used, room accessed and (where applicable) associated booking and account holder. By making a booking you consent to the collection and use of this information.
Retention. CCTV footage and access logs are retained for 30 days, after which they are securely deleted, except where required to be retained for longer to investigate a suspected breach of these Terms, an incident, a safety matter, an insurance claim or where required by law.
Footage and logs may be reviewed for the purposes of investigating breaches of these Terms, damage, theft, safety incidents, disputes, and complying with lawful requests from police or regulators.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy sets out in full how we collect, use, store and disclose personal information, and how you may access or correct your personal information or make a complaint.
11. Schedule of Fines
The following fines apply in addition to any other remedy available to us, including termination of your session, account suspension and recovery of damages. Fines are charged automatically to the payment method on file.

You may appeal a fine within 14 days of being notified by emailing us with your booking reference and the reasons for your appeal. We will review the relevant CCTV footage, access logs and other evidence and respond within a reasonable time. Our decision is final.
12. Suspension, Termination and Refusal of Entry
We reserve the right to refuse entry to, terminate the session of, or remove from the premises any person who: appears intoxicated; is behaving abusively, threateningly or unsafely; is in breach of these Terms; or who we reasonably believe poses a risk to people, property or the operation of the studios. No refund will be provided in these circumstances.
First breaches of the House Rules will generally result in a fine and a warning. Repeat breaches, or serious breaches involving fraud, violence, theft, criminal damage, drugs, or threats toward staff or other customers, will result in immediate and permanent termination of your account without warning.
On termination of your account, any active bookings will be cancelled and any credit balance may be forfeited (subject to your non-excludable rights under the Australian Consumer Law).
13. Indemnity
To the maximum extent permitted by law, you indemnify and hold harmless Resident Studios, its directors, officers, employees, contractors and agents from and against all losses, damages, liabilities, claims, demands, expenses and costs (including reasonable legal fees on a solicitor-and-own-client basis) arising out of or in connection with: (a) any breach by you or your guests of these Terms; (b) any damage to property caused by you, your guests or any person who entered the premises using your PIN; (c) any injury, loss or damage suffered by any of your guests; (d) any claim brought against us by a third party arising from your conduct or your use of the premises; and (e) any breach by you of any law or regulation.
14. Limitation of Liability
Our liability is capped at the amount you paid for the relevant booking. To the maximum extent permitted by law, our total aggregate liability to you, whether in contract, tort (including negligence), under statute or otherwise, in connection with any booking, the use of our premises, equipment or services, is limited to the amount you actually paid to us for the booking giving rise to the claim.
To the maximum extent permitted by law, we are not liable for any indirect, consequential, special or punitive loss, including loss of profits, loss of opportunity, loss of recordings or data, or loss of goodwill, however arising.
Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded. Where our liability for breach of a non-excludable consumer guarantee can be limited, our liability is limited (at our option) to re-supplying the services or paying the cost of re-supply.
We are not liable for loss, theft or damage to your personal property brought onto the premises.
15. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms where the failure or delay is caused by events outside our reasonable control, including (without limitation): fire, flood, storm or other natural disaster; pandemic or public health order; act of God; war, terrorism, riot or civil unrest; strike or industrial action; failure of utilities, internet or telecommunications; government order or restriction; or any other event of force majeure.
Where a force majeure event prevents us from providing your booking, we will offer you a credit of equivalent value or a refund, at your election.
16. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on our website and at the premises. Continued use of our services after a change takes effect constitutes acceptance of the updated Terms. Material changes will be notified to account holders by email.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Australia and the State or Territory in which the relevant studio is located. You submit to the non-exclusive jurisdiction of the courts of that State or Territory and the courts of the Commonwealth of Australia.
